#Malaysia: Flash Flood Victims Can Sue Local Authorities For Damages

Were you one of the victims affected by the flash floods 2 weeks ago? Well, here’s an option you can consider: sue the local authorities.

Lawyer Syahredzan Johan told Bernama that victims of the recent flash floods in the city can choose to sue local authorities for damages. However, they would need to provide evidence supported by relevant experts to show negligence by the local authority concerned.

“For instance, in this case, the victims can get advice from experts in engineering to testify on their behalf in court. The testimony will be based on evidence, such as the witness testimony, newspaper clippings, pictures of the incident and receipts for payments made in the case,” said Syahredzan. As such, victims seldom pursue the matter due to the high expanses in getting professional advice.

In the same report, Kuala Lumpur Mayor Datuk Seri Mhd Amin Nordin Abd Aziz said Kuala Lumpur City Hall (DBKL) was prepared if victims of the flash floods intend to sue them. “We have our own lawyers to resolve the matter,” he told national news agency.

On 12th May, a series of flash floods occurred in the city as a result from the heavy downpour. Several major roads were submerged including Jalan Pudu, Jalan Pantai Bahru, Jalan Semantan, and Jalan Bangsar which affected more than 100 vehicles.

The Federal Territories Ministry announced last week that DBKL has already identified the causes of the flash floods and is already conducting inspection as well as cleaning of the drainage system in the city.
